About This Agreement:

MyUblo reserves the right to change or modify the content of the following user agreement. It is your responsibility to review this agreement on a regular basis in order to keep yourself aware of any changes. By using MyUblo services, you agree to comply to all applicable regulations posted in this User Agreement. If, for any reason, you do not agree to any of these regulations or subsequent modifications, please discontinue use of services offered by MyUblo.

Content of MyUblo:

MyUblo is not responsible for any content made available by users through its service. You understand that all listings, text, images, and other contents of MyUblo are the sole responsibility of his or her originator. Each user is solely responsible for each and every item posted and therefore responsible if item is found to be offensive, indecent, inexact, or ambiguous. By using MyUblo, you understand that you may encounter such item. In addition, MyUblo website may contain links to other websites, which are entirely independent of MyUblo. You understand that connecting to these other websites is at your own risk and that you will consequently endorse all related consequences of doing so. MyUblo cannot control and does not pre-approve content and therefore is not responsible for these websites. However, MyUblo reserves the right to reject or remove any content that is available through its service due to violation of regulations or other reasons.

Third Party Content, Sites, and Services:

MyUblo website and content may contain features and/or advertisement links which may allow you access to third party content and services, which are entirely independent of MyUblo. It is your responsibility to research these companies, organizations, and/or individuals prior to exchanging information, dealing with (buying or selling of goods), and accepting services from them. You agree that MyUblo shall not be responsible or liable for any loss or damage of any sort as a result of any such dealings. If there is a dispute between users of MyUblo, or between users and any third party, you understand and agree that MyUblo is not obligated to become involved.

Code of Conduct:

MyUblo strictly prohibits the use of foul language on the site. You will not defame any individual or group of people in your postings or emails that you sent through MyUblo. You understand that any offensive material used in MyUblo sites will not be tolerated and will be removed. In the event that such activity or language occurs, please report it as such.

MyUblo strictly prohibits the posting of ads and services that;

• contain pornography or individuals engaging in sexual activities
• ask for sex from under age persons
• offer sex or sexual activities in exchange for money, products or services
• depict a person(s), regardless of gender, engaged in actual sexual conduct
• contain bestiality
• contain masturbation
• contain sadistic or masochistic abuse
• harass or contain "hate speeches" toward an individual or a group on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability
• violate the Fair Housing Act by stating a discriminatory preference based on race, color, national origin, religion, sex, familial status, or handicap in the sale or rental of a property.
• violate federal, state, or local equal employment opportunity laws by stating employment preferences or requirement based on race, color, religion, sex, national origin, age, or disability.
• impersonate any person or entity or falsely states or misrepresents affiliation with a person or entity
• identify information about another person without that person's explicit consent in writing
• are false, deceptive, misleading or deceitful
• contain "affiliate marketing," "link referral code," "junk mail," "spam," "chain letters," "pyramid schemes," or unsolicited commercial advertisement
• violate any patent, trademark, trade secret, copyright, or other proprietary rights of any party or material that you do not have a right to make available under law
• constitute or contain any form of advertising, solicitation or links to commercial services if posted in non-designated areas or emailed to MyUblo users without prior consent
• advertise any illegal service or the sale of any illegal items (refer to "Illegal Items and Services" section for partial list of prohibited items
• contain software viruses or other computer code, files or programs designed to disrupt, destroy or limit operation of any computer software or hardware.

You also understand that you will not:

• contact anyone who has asked not to be contacted
• stalk or harass anyone
• collect personal data about other users for commercial or unlawful purposes
• post irrelevant content
• post multiple Ads that are too similar to each other
• impose an unreasonable large load on our site
• post an Ad that serves no other purpose than to send traffic to another web site
• post an Ad that encourages others to break the law
• attempt to gain unauthorized access of MyUblo's databases or engage in any activity that disrupts the quality of services provided by MyUblo
• use any form of automated device or computer program that allows the submission of postings on MyUblo's sites

Illegal Items and Services:

• Alcoholic Beverages
• Blood, Bodily Fluids and Body Parts
• Burglary Tools
• Counterfeit currency, stamps or coins
• Counterfeit Products
• Electronic Surveillance Equipment
• Embargoed Goods
• Escort services that offer or indicate sexual services
• Illegal Drugs & Drug Paraphernalia
• Illegal Services
• Illegal telecommunication and electronics equipment such as access cards, password swiffers, radar scanners, traffic signal control devices or cable descrambler
• Hazardous Materials including but not limited to radioactive, toxic and explosive materials
• Fireworks, Destructive Devices and Explosives
• Identity Documents, Personal Financial Records & Personal Information (in any form, including mailing lists)
• Items which encourage or facilitate illegal activity
• Lottery Tickets, Sweepstakes Entries and Slot Machines
• Material that is obscene, pornographic or adult in nature, or harmful to minors
• Offensive Material
• Pictures or images that contain nudity
• Government and Transit Badges, Uniforms, IDs, Documents and Licenses (e.g. internal manuals of commercial airlines, police or postal service uniforms)
• Prescription Drugs and Devices
• Prostitution or ads that offer sex, sexual favors or sexual actions in exchange for money
• Recalled items
• Stocks and Other Securities
• Stolen Property
• Tobacco Products
• Used Cosmetics
• Used or rebuilt batteries or batteries containing mercury
• Weapons and related items (such as firearms, firearm parts and magazines, ammunition, BB and pellet guns, tear gas, stun guns, switchblade knives, and martial arts weapons)

The following types of job postings are not allowed on the site:

• Multi-level marketing or pyramid schemes
• Business or job opportunities that require upfront or periodic payments
• Business or job opportunities that pay only commissions, unless the Ad makes it clear that the sole source of compensation would be commission and clearly describes the product or service that would be sold
• Business or job opportunities that require recruitment of other members, distributors or agents
• Ads that are not clear regarding what type of work would be required
• Ads for employment that are stating a preference or requirement based on race, color, religion, sex, national origin, age or disability

Copyright Complaints:

MyUblo respects the intellectual property of others, and we ask our users to do the same. MyUblo may, in appropriate circumstances and at its discretion, suspend or terminate the access of and take other action against users, subscribers, registrants and account holders who infringe the copyright rights of others.

If you believe that your work has been copied and is accessible on the Website in a way that constitutes copyright infringement, or that the Website contains links or other references to another online location that contains material or activity that infringes your copyright rights, you may notify us by providing the following information (as required by the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act, 17 U.S.C. sec. 512) to our copyright agent set forth below:

1. A physical or electronic signature of person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
2. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit MyUblo to locate the material;
4. Information reasonably sufficient to permit MyUblo to contact the complaining party, such as an ad
5. dress, telephone number, and if available, an electronic mail address at which the complaining party may be contacted;
6. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
7. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

Listing Fees:

MyUblo.com is completely free for all users

Third-party or Posting Agent:

You may not use a third-party agent to post your listing without prior approval of MyUblo. Also, third party agents may not post any content on behalf of others without written consentient or license from MyUblo.

Anti-Spam Policy:

MyUblo encourages you to use our service as long as you abide by the MyUblo User Agreement and MyUblo prohibition on spamming and unethical marketing activities. The following are some examples of spamming that may violate the MyUblo Anti-Spam Policy:

• Manipulating identifiers, such as email headers, to disguise the origin of any content transmitted to or through MyUblo computer systems.
• Relaying email from a third party's mail servers without the permission of that third party.
• Using or causing to be used MyUblo computer systems to facilitate the transmission of unsolicited or unauthorized material. This includes any promotional materials, URLs, "junk mail," "chain letters," "pyramid schemes," or any other form of unauthorized solicitation that you may upload, post, email, transmit, or otherwise make available.
• Using "robots" or otherwise harvesting other's email addresses from the MyUblo site for purposes of sending unsolicited or unauthorized material.
• Uploading, posting, emailing, or transmitting the same message, URL, or post multiple times.
• Disrupting the normal flow of dialogue, or causing the screen to "scroll" faster than other users of the service are able to type, or otherwise acting in a manner that negatively affects other users' ability to engage in real-time exchanges.

Violations of our User Agreement or this Anti-Spam Policy may result in legal action against you and the termination, without notice, of your MyUblo ID and/or anything associated with it, including, but not limited to, email accounts, posts, home pages, and profiles. Nothing in this policy is intended to grant any right to transmit email to or through MyUblo computer systems. MyUblo does not waive any rights by the failure to enforce this policy in every instance in which it might apply.

Limitations and Access:

You understand that MyUblo may establish limits concerning use of MyUblo sites, including the maximum number of days that postings will be retained, the maximum number and size of postings, email messages, or other material that may be transmitted or stored by MyUblo. You agree that MyUblo has no responsibility or liability for the deletion or failure to store any postings maintained or transmitted by MyUblo. You acknowledge that MyUblo reserves the right at any time to modify or discontinue the site with or without notice, and that MyUblo shall not be liable to you or to any third party for any modification, suspension or discontinuance of the MyUblo website.

MyUblo grants you a limited, revocable, nonexclusive license to access the site for your own personal use. This license does not include: (i) access to the Service by Posting Agents; or (ii) any collection, aggregation, copying, duplication, display or derivative use of the site nor any use of data mining, robots, spiders, or similar data gathering and extraction tools for any purpose unless expressly permitted by MyUblo. A limited exception to (ii) is provided to general purpose internet search engines and non-commercial public archives that use such tools to gather information for the sole purpose of displaying hyperlinks to the site, provided they each do so from a stable IP address or range of IP addresses using an easily identifiable agent and comply with our robots.txt file. "General purpose internet search engine" does not include a website or search engine or other service that specializes in classified listings or in any subset of classifieds listings such as jobs, housing, for sale, services, or personals, or which is in the business of providing classified ad listing services.

MyUblo permits you to display on your website, or create a hyperlink on your website to, individual postings on the site so long as such use is for noncommercial and/or news reporting purposes only (e.g., for use in personal web blogs or personal online media). You may create a hyperlink to the home page of MyUblo site so long as the link does not portray MyUblo, its employees, or its affiliates in a false, misleading, derogatory, or otherwise offensive manner.

Use of MyUblo sites beyond the scope of authorized access granted to you by MyUblo immediately terminates said permission or license. In order to collect, aggregate, copy, duplicate, display or make derivative use of the site or any Content made available via the site for other purposes (including commercial purposes) not stated herein, you must first obtain a license from MyUblo.

Violation of Terms:

Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.

Termination of Service:

You agree that MyUblo, in its sole discretion, may delete or deactivate your account, with or without prior warning, if MyUblo believes that you have violated the User Agreement. Further, you agree that craigslist shall not be liable to you or any third-party for any termination of your access to MyUblo sites. In addition, you agree not to attempt to use the MyUblo sites after said termination.

Proprietary Rights:

MyUblo website is protected to the maximum extent permitted by copyright laws and international treaties. Any content displayed on or through the site is protected by copyright as a collective work and/or compilation, pursuant to copyrights laws, and international conventions. Any reproduction, modification, creation of derivative works from or redistribution of the site or the collective work, and/or copying or reproducing the sites or any portion thereof to any other server or location for further reproduction or redistribution is prohibited without the express written consent of MyUblo. You further agree not to reproduce, duplicate or copy any content from MyUblo sites without the express written consent of MyUblo, and agree to abide by any and all copyright notices displayed on the website. You may not decompile or disassemble, reverse engineer or otherwise attempt to discover any source code contained in the site. Without limiting the foregoing, you agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any aspect of the site. MyUblo is a registered mark in the U.S. Patent and Trademark Office.

Although MyUblo does not claim ownership of content that its users post, by posting content to any public area of the MyUblo website, you automatically grant, and you represent and warrant that you have the right to grant, to MyUblo an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute said content and to prepare derivative works of, or incorporate into other works, said content, and to grant and authorize sublicenses (through multiple tiers) of the foregoing. Furthermore, by posting content to any public area of the site, you automatically grant MyUblo all rights necessary to prohibit any subsequent aggregation, display, copying, duplication, reproduction, or exploitation of the content on the service by any party for any purpose.

Indemnity:

You agree to indemnify and hold MyUblo, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of content you submit, post or make available through the MyUblo website, your use of the website, your violation of the MyUblo User Agreement, your breach of any of the representations and warranties herein, or your violation of any rights of another.

DISCLAIMER OF WARRANTIES:

YOU AGREE THAT USE OF THE MYUBLO WEBSITE AND SERVICES IS ENTIRELY AT YOUR OWN RISK. THE MYUBLO WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" OR "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND. ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW. TO THE FULLEST EXTENT PERMITTED BY LAW, MYUBLO DISCLAIMS ANY WARRANTIES FOR THE SECURITY, RELIABILITY, TIMELINESS, ACCURACY, AND PERFORMANCE OF THE MYUBLO WEBSITE AND SERVICES. TO THE FULLEST EXTENT PERMITTED BY LAW, MYUBLO DISCLAIMS ANY WARRANTIES FOR OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE MYUBLO WEBSITE OR SERVICES, OR ACCESSED THROUGH ANY LINKS ON THE MYUBLO WEBSITE. TO THE FULLEST EXTENT PERMITTED BY LAW, MYUBLO DISCLAIMS ANY WARRANTIES FOR VIRUSES OR OTHER HARMFUL COMPONENTS IN CONNECTION WITH THE MYUBLO WEBSITE OR SERVICES. Some jurisdictions do not allow the disclaimer of implied warranties. In such jurisdictions, some of the foregoing disclaimers may not apply to you in so far as they relate to implied warranties.

LIMITATION OF LIABILITY:

UNDER NO CIRCUMSTANCES SHALL MYUBLO BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (EVEN IF MYUBLO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM ANY ASPECT OF YOUR USE OF THE MYUBLO WEBSITE OR SERVICES, WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF THE MYUBLO WEBSITE OR SERVICES, FROM INABILITY TO USE THE MYUBLO WEBSITE OR SERVICES, OR THE INTERRUPTION, SUSPENSION, MODIFICATION, ALTERATION, OR TERMINATION OF THE MYUBLO WEBSITE OR SERVICES. SUCH LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR PRODUCTS RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE MYUBLO WEBSITE OR SERVICES OR ANY LINKS ON THE MYUBLO WEBSITE, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE MYUBLO WEBSITE OR SERVICES OR ANY LINKS ON THE MYUBLO WEBSITE. THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. In some jurisdictions, limitations of liability are not permitted. In such jurisdictions, some of the foregoing limitation may not apply to you.
